1. Agreement to Terms

Welcome to RiseWork! These Terms of Service ("Terms") govern your use of:

• The RiseWork mobile application (the "App")
• The RiseWork website at risework.app (the "Website")

Together referred to as our "Services," operated by RiseWork ("we," "us," or "our").

By downloading, installing, accessing, or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our Services.

2. Description of Service

RiseWork is a job search companion that helps users:

• Track job applications and maintain consistency
• Build and tailor resumes for specific job opportunities
• Generate cover letters using AI assistance
• Follow a guided journey to employment
• Stay motivated through gamification features

3. Eligibility

To use RiseWork, you must:

• Be at least 13 years of age (or the minimum age in your jurisdiction)
• Be capable of forming a binding contract
• Not be prohibited from using the Services under applicable law

If you are between 13 and 18 (or the age of majority in your jurisdiction), you must have your parent or guardian's permission to use the Services.

4. Account Registration

4.1 Account Creation

To access certain features, you must create an account by providing:

• A valid email address
• A secure password
• Basic profile information

4.2 Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Providing accurate and truthful information

4.3 Account Termination

We reserve the right to suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Abuse the service or other users
• Provide false information

5. User Content

5.1 Your Content

You retain ownership of all content you submit to the Services, including:

• Resume information
• Cover letters
• Job application data
• Profile information
• Notes and entries

5.2 License to Us

By submitting content to the Services, you grant us a limited license to:

• Store and process your content to provide the service
• Use AI to analyze and improve your content
• Display your content back to you within the Services

This license is non-exclusive, royalty-free, limited to operating and improving the Services, and terminated when you delete your content or account.

5.3 Content Guidelines

You agree not to submit content that:

• Is false, misleading, or fraudulent
• Infringes on intellectual property rights
• Contains malware or harmful code
• Violates any applicable law
• Is offensive, harassing, or discriminatory

6. AI-Powered Features

6.1 AI Services

RiseWork uses artificial intelligence to:

• Tailor your resume for specific job applications
• Generate cover letter drafts
• Provide personalized suggestions
• Offer motivational messages

6.2 AI Limitations

You understand and agree that:

• AI-generated content is a starting point and should be reviewed
• We do not guarantee AI outputs are error-free
• You are responsible for reviewing and editing AI-generated content
• AI suggestions are not professional career advice
• AI cannot guarantee job placement or interview success

6.3 Your Responsibility

You agree to:

• Review all AI-generated content before using it
• Ensure accuracy of your resume and cover letters
• Not rely solely on AI for critical career decisions
• Verify all information before submitting applications

7. Subscription and Payments

7.1 Free Tier

RiseWork offers free features including:

• Basic journey tracking
• Application logging
• Streak and achievement tracking
• Limited AI credits for trial

7.2 Pro Subscription (When Available)

Premium features may require a paid subscription. When offered:

• Pricing will be clearly displayed before purchase
• Subscriptions auto-renew unless cancelled
• Payments processed through Apple App Store or Google Play Store
• Refunds subject to Apple/Google policies

7.3 AI Credits

• Free users receive limited AI credits
• AI credits are consumed when using AI features
• Unused credits do not roll over (unless specified)
• Credits have no monetary value and cannot be transferred

7.4 Changes to Pricing

We may change pricing with reasonable notice. Changes will not affect current subscription periods.

8. Website Use

When using our Website, you agree to:

• Not interfere with the proper functioning of the Website
• Not attempt to gain unauthorized access to any systems
• Not use automated tools to scrape or collect data
• Not use the Website for any unlawful purpose

9. Intellectual Property

9.1 Our Property

RiseWork and its original content, features, and functionality are owned by us and protected by:

• Copyright
• Trademark
• Other intellectual property laws

This includes:

• App and website design and interface
• Kai companion character and messages
• Journey framework and gamification system
• Logos, icons, and branding

9.2 Restrictions

You may not:

• Copy, modify, or distribute the Services
• Reverse engineer or decompile the App
• Remove any proprietary notices
• Use our trademarks without permission
• Create derivative works based on the Services

10. Prohibited Uses

You agree NOT to use the Services to:

• Violate any laws or regulations
• Infringe on others' intellectual property
• Transmit spam, malware, or harmful content
• Attempt to gain unauthorized access
• Interfere with the Services' operation
• Impersonate others or provide false information
• Scrape data or use automated systems
• Resell or commercialize the Services
• Use AI credits fraudulently
• Create multiple accounts to abuse free features

11. Disclaimer of Warranties

We specifically disclaim warranties regarding:

• Merchantability and fitness for a particular purpose
• Accuracy or reliability of any information
• Uninterrupted or error-free operation
• Results from using the Services
• Job placement or career success

We do not guarantee that:

• The Services will meet your requirements
• AI-generated content will be accurate
• You will receive job interviews or offers
• The Services will be available at all times

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

We shall not be liable for any:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Damages arising from your use of the Services
• Damages exceeding the amount you paid us (if any)

This includes damages arising from:

• Use or inability to use the Services
• Errors in AI-generated content
• Unauthorized access to your account
• Third-party actions or content
• Job search outcomes

Some jurisdictions do not allow limitation of liability, so some limitations may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless RiseWork, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any rights of others
• Content you submit to the Services

14. Third-Party Services

The Services may contain links to or integrate with third-party services. We are not responsible for:

• The content or practices of third-party services
• Privacy practices of third parties
• Your interactions with third parties

Your use of third-party services is at your own risk.

15. Modifications to Service

We reserve the right to:

• Modify or discontinue features at any time
• Update the Services and their functionality
• Change AI providers or capabilities
• Adjust credit allocations

We will provide reasonable notice for significant changes.

16. Termination

16.1 By You

You may terminate your account at any time by:

• Using the "Delete Account" feature in Settings
• Contacting us at hello@risework.app

16.2 By Us

We may terminate or suspend your account:

• For violation of these Terms
• For illegal or harmful activity
• At our discretion with reasonable notice

16.3 Effect of Termination

Upon termination:

• Your right to use the Services ceases immediately
• Your data will be deleted (subject to legal requirements)
• Provisions that should survive will remain in effect

17. Governing Law and Disputes

17.1 Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict of law principles.

17.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Services will be resolved through:

1. Informal Resolution: Contact us at hello@risework.app to resolve issues amicably
2. Mediation: If informal resolution fails, disputes may be submitted to mediation
3. Arbitration/Courts: As a last resort, disputes will be resolved through binding arbitration or the courts of Ontario, Canada

17.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

18. General Provisions

18.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RiseWork.

18.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

18.3 Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

18.4 Assignment

We may assign these Terms without restriction. You may not assign your rights or obligations without our consent.

18.5 Force Majeure

We are not liable for failures caused by circumstances beyond our reasonable control.

19. Changes to Terms

We may update these Terms from time to time. We will notify you of changes by:

• Posting updated Terms on our Website and in the App
• Updating the "Last Updated" date
• Sending notification for significant changes

Your continued use of the Services after changes constitutes acceptance of the new Terms.

21. End User License Agreement (EULA)

21.1 License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the RiseWork mobile application on a device you own or control, solely for your personal, non-commercial purposes.

21.2 License Restrictions

You may not:

• Copy, modify, or redistribute the application or any part of it
• Reverse engineer, decompile, disassemble, or attempt to extract the source code
• Sublicense, sell, rent, lease, or transfer the application to any third party
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the application to build a competing product or service

21.3 Termination of License

This license is effective until terminated. It terminates automatically if you fail to comply with any provision of these Terms. Upon termination, you must cease all use and destroy all copies of the application.

21.4 Updates

We may release updates to the application from time to time. Some updates may be required for continued use. We are not obligated to provide updates, maintenance, or support.

21.5 Third-Party Terms

Use of the application is also subject to the terms of your mobile platform provider (Apple App Store or Google Play Store), including their standard EULA terms where applicable.

22. XP, Credits, and Virtual Rewards

22.1 Nature of Virtual Items

RiseWork features a gamification system that includes experience points ("XP"), AI credits, badges, streaks, levels, and other virtual rewards (collectively, "Virtual Items"). Virtual Items are provided to enhance your experience and motivate your job search progress.

22.2 No Monetary Value

22.3 Adjustments and Changes

We reserve the right to modify, adjust, or reset Virtual Items at any time, including but not limited to:

• Changing the rate at which XP or credits are earned
• Modifying the cost of AI actions in credits
• Adding, removing, or modifying badges and achievements
• Adjusting streak mechanics or grace periods
• Resetting balances in the event of abuse or system errors

We will make reasonable efforts to notify users of significant changes.

22.4 Forfeiture

All Virtual Items are forfeited upon account deletion or termination. No compensation will be provided for lost Virtual Items.

23. Referral Program

23.1 Overview

RiseWork may offer a referral program that allows users to earn XP rewards by inviting others to use the service. Participation is voluntary and subject to these terms.

23.2 Referral Rewards

• Referrer: May earn XP when a referred user signs up and reaches specified milestones
• Referred User: May receive a starter XP bonus upon joining via a referral code

Referral rewards are paid in XP, which is subject to all provisions of Section 22 (XP, Credits, and Virtual Rewards), including that XP has no monetary value.

23.3 Prohibited Conduct

The following actions constitute referral abuse and may result in reward forfeiture and/or account termination:

• Creating multiple accounts to self-refer
• Using fake, disposable, or fraudulent accounts to generate referrals
• Spam distribution of referral codes
• Any attempt to manipulate or exploit the referral system

23.4 Program Changes

We reserve the right to modify, suspend, or discontinue the referral program at any time, with or without notice. Referral codes may be revoked if abuse is detected. Reward amounts and milestone requirements are subject to change.

24. Subscription Disclosure

24.1 Auto-Renewal

If and when premium subscriptions are offered, they will auto-renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the renewal date.

24.2 Billing

• The exact subscription price, billing frequency, and renewal date will be displayed clearly on the subscription screen before you confirm any purchase
• Payment is charged to your Apple ID or Google Play account at confirmation of purchase
• Your account will be charged for renewal within 24 hours prior to the end of the current period

24.3 Cancellation

To cancel your subscription:

• iOS: Settings → [your name] → Subscriptions → RiseWork → Cancel Subscription
• Android: Google Play → Menu → Subscriptions → RiseWork → Cancel

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that date. Deleting the app does not cancel your subscription.

24.4 Refunds

Refund requests are handled by Apple or Google according to their respective policies. RiseWork does not process refunds directly.

By using RiseWork (app or website), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
